Am I restricted to the templates provided within EziMerchant for my website design or am I able to use my own designs?

You can create your own template if you know a bit about html and page layout etc.
I have created lots of templates for ezimerchant so if anyone wants one customised for their business just check out my website at www.webcontent.com.au

I had the same problem, i found a guy who did it in the states, his charges are reasonable considering the work he puts into it. His URL is http://www.practical-webs.com
I would like to know if you can implement a fold out menu to your ezimerchant categories as people dont often like going to another page for the sub-categories.

We are implementing a fold out menu in V4.0 of ezimerchant professional which we are planning to bring out christmas this year.
We dont have an upgrade price or final release date yet (or a list of confirmed features) - Keep an eye out on our website for more information later in the year.

If you open up a theme template in your fav editor you will see how easy it is to modify the layout ..
I did this with www.buymethatnow.com . I have made a manual navigation to link to catogories .. this is not a problem because once you set your catogories they always keep the same page name .. so its only a case of dropping or adding in to the nav for each change to catogories you make ..
what I initially did is back up a theme and dump it in to the root of c: then go back in to my editor and edit the one supplied in the theme folders ..
If you do make any modifications remember to delete the modified files in the theme folder b4 you rebuild the site .. the software gets its info from these rather than the orig files .. if you look in the directory of the theme you use you will see there is a modviewcart and a viewcart.htm ..
You can also change the fonts and stuff in the system.ini file located in the theme folders .. however b4 you change any of these I HIGHLY recommend backing up all files first !!.. If you are unsure then probably best to leave them alone ..
